MEMORANDUM OF UNDERSTANDING ON AGRICULTURAL AND AGRIBUSINESS COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE KINGDOM OF CAMBODIA
The Government of the Republic of the Philippines, represented herein by the Department of Agriculture, and the Government of the Kingdom of Cambodia, represented herein by the Ministry of Agriculture, hereinafter referred to as the "Contracting Parties";
Desiring to strengthen the existing friendly relations between the two countries through cooperation in the development of both countries' agricultural sectors;
Hereby agree to pursue joint undertakings and exchanges in the field of agriculture and promotion of agricultural products through this Memorandum of Understanding (hereinafter referred to as "Memorandum"), to be implemented as follows:
ARTICLE I
Joint activities will be undertaken as follows:
1.1 Cooperation will be in the areas of agricultural planning, aquaculture, animal feed resource development, animal health protection programming and planning, agricultural marketing information system, human resource development, irrigation system management, and other fields as may be agreed upon by both Parties.
1.2 To further promote international agricultural trade and agribusiness investments, both Parties shall endeavor to facilitate trade in accordance with each Party's development and trade needs and objectives on the basis of equality and mutual benefit.
1.3 Joint undertaking and exchanges will be implemented in conformity with the laws and agricultural policies of both countries.
ARTICLE II
Cooperation will be effected through the exchange of information; the exchange of scientists, experts and trainees; joint publication of studies and papers; organization of training, workshops and conferences related to agricultural and agribusiness development; conduct of strategic market facilitation activities including agricultural trade fairs and special exhibitions; joint ventures, and other means as may be agreed upon.
ARTICLE III
To generate broad interest and increased activities, this Memorandum authorizes the involvement of other interested government agencies as well as the scientific, academic and business communities and farmer organizations of both countries. The Parties will encourage and facilitate direct contacts between these groups to work toward long-term cooperation in developing agriculture, as well as trade and investments.
ARTICLE IV
A Joint Committee on Cooperation in Agriculture will be formed to facilitate cooperation, provide guidance, identify specific activities that will lead to the implementation of this Memorandum, and review the progress of such activities.
The Joint Committee shall meet at least once every two years, alternately in their respective countries, or more frequently as may be deemed necessary. In the interim, identified focal points from the agriculture ministries of both Parties shall communicate whenever necessary, to facilitate project implementation, and monitor development of activities under the MOU.
ARTICLE V
Each Party will bear the costs of its participation in cooperative activities unless the Parties agree on other arrangements. Activities pursuant to this Memorandum are subject to the availability of funds and personnel and to the laws and regulations of the respective countries of the Parties.
ARTICLE VI
Nothing in this Memorandum shall be interpreted to prejudice or modify existing understandings and agreements between the Parties.
ARTICLE VII
This Memorandum shall enter into force upon signature and shall remain in force for five (5) years, unless terminated earlier by either Party upon six-month written notice to the other Party. It may be modified or extended through written confirmation of both Parties. In the event of the termination of this Memorandum, the Parties shall consult with each other regarding the completion of the activities underway.
IN WITNESS WHEREOF, the undersigned, duly authorized by their respective Governments, have signed this Memorandum.
Done at Phnom Penh, Kingdom of Cambodia, the 17th day of December 1995, in two original texts, both in the English language, during the official visit of His Excellency Fidel V. Ramos, President of the Republic of the Philippines to the Kingdom of Cambodia on 17 to 18 December 1995.
