MEMORANDUM OF UNDERSTANDING BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE FEDERAL REPUBLIC OF GERMANY CONCERNING IMMIGRATION AND VISA MATTERS

Note: The Agreement entered into force, March 3, 1964.

1. Either Contracting Party shall, in accordance with its laws, facilitate and encourage the entry into and sojourn in its territory of tourists and businessmen of the Other Party, and facilitate the entry into and sojourn in its territory of technicians of the Other Party.

2. With respect to paragraph 1, either Party shall take into account the needs of the firm or agency requesting such technicians. It is agreed that, with respect to German pre-arranged employees, the visas will, in principle, be issued for a period of stay of three years with the possibility of extension,

3. Upon the entry into force of the Trade Agreement to be concluded between the two Parties, the Philippine Government agrees to admit as non-immigrants into the territory of the Philippines

(a) German nationals who seek to enter the territory of the Philippines solely to carry on substantial trade principally between the territories of the two countries;

(b) German nationals who seek to enter the Philippines solely in connection with investments by German nationals or companies in the Philippines; and

(c) Spouses and unmarried minor children of persons referred to in sub-paragraphs (a) and (b), if accompanying or following to join such nationals.

The word "substantial" as used herein with reference to trade or investments shall not be interpreted to discourage particular types of investment or necessarily to exclude small traders or investors.

4. The Government of the Federal Republic of Germany shall facilitate the entry into and sojourn in its territory of Filipino traders and investors.

5. Persons who enter the territory of either country in accordance with the provisions of paragraphs 3 and 4 shall be permitted to stay therein during such period as they maintain, the status under which they were admitted.

6. The provisions of the preceding paragraphs shall be subject to the rights of either Government to exclude or expel particular individuals on any of the grounds specified in their laws, for the purposes of protecting public order, health, morality and safety.

7. The matter of permanent residence of nationals of either country in the territory of the other shall be outside the scope of this Memorandum of Understanding.
