The Food and Agriculture Organization of the United Nations (hereinafter called "the Organization") and the Government of the Republic of the Philippines (hereinafter called "the Government") desire, provided the necessary funds are available to the Organization, to give effect to Resolution 340 (IV) on an Expanded Program of Technical Assistance for Economic Development of Under-Developed Countries, adopted by the General Assembly of the United Nations on 16 November 1949, through the establishment and operation of a Training Centre for Mechanical Logging (hereinafter called "the Centre") in the Philippines (hereinafter called "the Country") to meet the need of Far Eastern countries for the training of staff in the use of modern machinery for the extraction of forest products.

THEREFORE, the Organization and the Government, declaring that their mutual responsibilities shall be fulfilled in a spirit of friendly cooperation and that the detailed application of such responsibilities shall be arranged on a basis of mutual understanding, have entered into this Agreement through their undersigned duly authorized representatives.

ARTICLE I

TECHNICAL ASSISTANCE TO BE PROVIDED

(a) The Centre shall be organized and conducted by the Organization in collaboration with the Government, shall commence on or about 1 October 1952 and shall continue for a period of approximately six (6) months. The Centre shall be located at such places within the Country where logging operations are being carried out. The selection of these places shall be determined jointly between the Organization and the Government.

(i) The Government shall provide an honorary Co-Director of the Centre, one instructor and not less than two (2) assistant instructors in logging engineering and all local secretarial, interpreter/translator and later and related assistance necessary for the efficient operation the Centre.

(ii) The Organization shall provide the Co-Director and one instruct (hereinafter called "the Personnel"). The Co-Director shall be solely responsible for the direction of the Centre and the instructor shall be responsible for the operation, care and maintenance of the diesel tractor equipment.

(b) The Organization shall issue invitations to the governments of Far Eastern countries to send students to the Centre.

(c) The work of the Centre shall include practical field work, lectures and discussions on mechanical logging operations including reference to the administration and supervision thereof. The subjects for study shall include:

(1) Felling of timber;

(2) Hauling from stump to roadside;

(3) Road construction;

(4) Transport of forest products from forest to site of processing plant;

(5) Administration and management considerations in mechanical logging installations;

(6) Guiding principles in the formulation of plans and programs for mechanical logging operations;

(7) Financial considerations.

The precise curriculum and procedures of the Centre shall be determined by the Organization in consultation with the Government.

(d) At the conclusion of the Centre the Organization shall arrange for the publication of a report on the Centre's organization and activities.

(e) At the conclusion of the Centre the Organization may provide fellowships abroad for not more than five (5) outstanding students for further study in the field of mechanical logging.

ARTICLE II

LIAISON

The Government designates the Department of Agriculture and Natural Resources as the central coordinating agency with which the Organization shall in connection with the technical assistance rendered under this Agreement.

ARTICLE III

DETAILED ADMINISTRATIVE AND FINANCIAL OBLIGATIONS

(a) The obligations of the Organization shall be as follows:

(i) The Organization shall pay the salaries of the Personnel provided by the Organization.

(ii) The Organization shall pay the cost of insurance of the Personnel provided by the Organization.

(iii) The Organization shall pay the cost of travel and subsistence of the Personnel provided by the Organization to and from the Centre and shall also pay to them a subsistence allowance during their stay at the Centre.

(iv) The Organization shall pay the cost of travel within the Country of the trainees and the staff of the Centre [except as provided in (b) (ii) below].

(v) The Organization shall pay the Co-Director, instructors and any other staff provided by the Government, a subsistence allowance during their stay at the Centre (except that those resident at Los Ba帽os shall receive this allowance only when they are away from the said municipality).

(vi) The Organization shall pay the trainees a monthly subsistence allowance in cash or provide subsistence in kind together with an incidental expenses allowance in cash at a rate not exceeding that fixed from time to time by the Technical Assistance Board for fellowship holders.

(vii) The Organization shall pay 50 per cent of the travel costs outside the Country of the trainees. The governments sending the trainees shall pay the remaining 50 per cent.

(viii) Although the Organization shall have no responsibility for any claim arising out of sickness or accident suffered by the trainees, the Organization shall provide health and accident insurance.

(ix) The Organization shall determine the necessity of hiring any demonstration equipment (and the type thereof) necessary for the proper functioning of the Centre and shall pay the cost thereof which shall not exceed the equivalent of US $10,000. (Ten thousand US dollars).

(x) The Organization shall determine the necessity of providing any ancillary equipment (and the type thereof) necessary for the proper functioning of the Centre and shall pay the cost thereof which shall not exceed the equivalent of one thousand US dollars (US $1,000).

(b) The obligations of the Government shall be as follows:

(i) The Government shall pay the salaries of the Co-Director, instructors and any other staff provided by the Government.

(ii) The Government shall pay the subsistence and travel of the Co-Director, instructors and any other staff provided by the Government from their place of residence to the assembly point (Los Ba帽os).

(iii) The Government shall provide all local duplication of documents.

(iv) The Government shall pay the cost of transportation within the Country of all equipment and supplies provided under this Agreement and all telephone, telegraph, postal and other communications expenses.

(v) The Government shall pay the cost of providing medical care and hospitalization for the personnel.

(vi) The Government shall pay any taxes or other duties not covered by the privileges and immunities under Article IV.

(vii) The Government shall make available all necessary lecture and office space and facilities, equipment and supplies, and any other facilities necessary for the operation of the training course the need for which shall be determined by the Organization in consultation with the Government.

(viii) The Government shall assist the staff of the Centre and the trainees in making suitable arrangements for their accommodation.

(ix) The Government shall provide a petty cash fund to cover the cost of any incidental expenses for which it is responsible.

ARTICLE IV

FACILITIES, PRIVILEGES AND IMMUNITIES

(a) The Government shall take all practicable measures to facilitate the activities of the Organization under Article I and to assist the Personnel and the trainees in obtaining such services and facilities as may be required to carry on these activities.

(b) Notwithstanding that the Government may or may not have already ratified or acceded to the Convention on the Privileges and immunities of the Specialized Agencies, the Government shall accord to the Personnel, the trainees and to the Organization, its property and assets in connection with the performance of this Agreement and supplemental agreements, all the privileges and immunities which are normally accorded to the Organization, its property, assets, officials and experts under the provisions of that Convention.

(c) The Organization, the expert and the trainees for technical assistance shall have the benefit of the most favourable legal rate for conversion of currency prevailing at the time of any conversion made in carrying out their responsibilities under this Agreement.

IN WITNESS WHEREOF the Government and the Organization have signed this Agreement at Manila this 3rd day of April, 1952, in four copies in English. The Agreement shall be in force as from this date.
